What are Procedural Safeguards?
At every IEP meeting there is a packet of information that is offered to the parent and/or guardian known as the Procedural Safeguards. This document explains all of the rights that are provided to a parent with a child who receives Special Education services or has a child who is going through a Special Education evaluation. These are applicable to children ages 3-21 years of age.
Offering Procedural Safeguards to parents and/or guardians is a required step in the Special Education process; therefore, the parent and/or guardian is asked to sign a statement confirming that they were offered a copy. Many parents ask if it is required that they take the packet, knowing they have multiple copies at home. The answer is no, a copy does not have to be taken, but the District needs to ensure that it is offered. At request, Procedural Safeguards can be provided at any time, not only at IEP meetings or when other documentation requiring them is issued. Procedural Safeguards can also be accessed online through the PaTTAN website. In an effort to provide the Procedural Safeguards ahead of time, and to also save on the amount of copies being printed, some teachers will send them digitally through email prior to the meeting. Once again, at any time, Procedural Safeguards can be requested either digitally or on paper.
The Procedural Safeguards contain information such as language and definitions utilized throughout the Special Education process, as well as information pertaining to specific documents. There are instructions on filing a due process complaint, filing a state complaint, and simply locating an advocate. There are a lot of details and explanations regarding terminology and processes. It is an important resource for parents and guardians to be aware of and have accessible.
